Pringle & Herigstad, P.C. is engaged in the general practice of law across North Dakota and bordering states. The firm works closely with its clients in the development of new ideas. Sometimes this means helping to redirect or redefine an idea so that a specific objective can be met. Whatever the situation, Pringle & Herigstad's role as counsel is one of active participation rather than the more traditional role of simply answering legal questions as they are asked.
The firm's practice is organized rather flexibly into six major areas. A brief synopsis of these areas of specialization follows:
LITIGATION
Pringle & Herigstad's litigation practice consists of trial and appellate work in both state and federal courts as well as proceedings before governmental agencies and tribal courts. The firm has experience in wrongful death, malpractice, products liability, and all types of personal injury cases including car accidents, farm accidents, train accidents, and burn cases.
BUSINESS PLANNING, CORPORATION AND SECURITIES LAW
Pringle & Herigstad's business practice includes regular involvement in all phases of a business entity's life. This encompasses the planning and organization of corporations, partnership and other entities, financing through private placements of equity securities, commercial borrowing through secured and unsecured transactions, leasing and other financing vehicles, and securities regulation reporting.
COOPERATIVE LAW One of the cornerstones of Pringle & Herigstad's practice throughout the past 95 years has been its extensive representation of cooperative businesses. These entities, which provide necessary services for the residents of North Dakota, include rural electric cooperatives, local cooperative grain elevators, local cooperative oil companies and similar organizations which provide data processing and marketing functions for their member cooperatives throughout the entire United States. The firm's representation of these clients includes regular involvement in all legal facets of the cooperatives' operation including: specific lobbying along with analysis of proposed legislation; obtaining financing through governmental or private sources; planning and structuring of acquisitions, mergers, and subsidiary corporations; representation in matters before the Federal Communications Commission and North Dakota Public Service Commission; and, litigation in both federal and state courts. Pringle & Herigstad, through its involvement in numerous complex legal transactions, and in litigation concerning cooperatives, has acquired a statewide and national reputation in the area of cooperative law.
BANKING AND COMMERCIAL LAW
Pringle & Herigstad represents lenders in the negotiation and drafting of loan agreements and related security agreements. It also represents creditors, especially secured creditors, in foreclosure and bankruptcy proceedings including reorganizations and liquidations. Additionally, Pringle & Herigstad represents the Federal Deposit Insurance Corporation (FDIC) in administration of insolvent financial institutions.
ESTATE PLANNING AND ADMINISTRATION
Pringle & Herigstad does extensive work in the area of estate planning, particularly with regard to clients owning farm and mineral properties. The firm provides services in all aspects of estate planning, the administration of estates and trusts, and fiduciary as well as individual income tax laws.
